法律用語としてのラテン語 Legal terms in Latin
法律に出てくるラテン語
法律の専門用語にはラテン語が多く含まれています。ラテン語は、ローマ帝国の公用語だったこともあり、広くヨーロッパで学問で用いられている言語です。イギリスにおいては、1731年まで、法律上、コモン・ロー裁判所の記録はすべてラテン語で書くことが求められていました。その名残で、ラテン語が多く使われているのです。
今まで、教科書やペーパーで見たことのあるラテン語について、少しまとめておくことにしました。以下のラテン語は、比較的良く使われているものではないかな、と思います。Et cetraなど、ラテン語と知らずに使っているおなじみの言葉もありました！
ラテン語と英語の関係など、もっと掘り下げて勉強したら面白いのでしょうけれど、なかなか余裕がないです。
☆判決理由に関する用語
Ratio decidendi = 'The reason for deciding' 判決理由のうち、主文の直接的な理由となるもの
Obiter dictum='A remark in passing' 判決理由のうち、主文の直接的な理由とならないもの
☆法則・原則
Bona fide = 'In good faith' 信義誠実に従って 善意の
Clausula rebus sic stantibus ='By the clause the situation thus remaining' 事情変更の原則
（ちなみにEstoppel（禁反言の法理）はフランス語）
Pacta sunt servanda ='Agreement must be kept' 合意は拘束する
Stare decisis ='To stand by things decided' 先例拘束の原則
☆国際法で主に使われる用語
Opinio juris sive necessitatis ='An opinion of law or necessity' 法的信念（国際慣習法の成立要件の一つ）
Terra nullius ='Nobody's land' 無主の地
☆管轄 (ratione) にまつわる用語
Ratione materiae ='By reason of the matter' 事項的管轄
Ratione tempolis =' By reason of time' 時間的管轄
Ratione loci ='By reason of the place' 場所的管轄
Ratione persone ='By reason of the person'人的管轄
☆参考文献を記載する際に使う用語
Et al. (alii, aliae, alia) = 'And others' その他〜 および〜 （参考文献の著者が複数の場合に使います）
Ibid ='In the same place' （既出の参考文献を記載する時に使います）

A priori ='From what is before' 原理からすると 自明な
Ad hoc = 'To this' 臨時の 特定の目的のために
Ad valolem 従価の 価格に応じて
De facto ='In fact' 事実上の
De jure ='From law' 法律上の 適法な as a matter of legal right; by right
De minimis ='The law is not concerned with tribial matters'
Erga omnes ='Towards all' 全ての人に対して 対世効のある with respect to all states or persons in a relevant group

Inter alia = 'Among other thing' とりわけ
（以下 j から始まる言葉は i で表記される場合もあります。そちらの方が主流だという人も）
Jus, Juris = 'Right; law' 権利 法
Jus cogens = 'Coercive law' 強行法規
⇔ Jus dispositivum = 'Law not settled by agreement' 任意規定
Non constat = 'It is not certain' 明白でないもの
Per pro (procurationem) = 'By the agency' 代理人が 代理人を通して
Prima facie ='At first sight' 一見明白な 一見したところ
Pro rate = 'In propotion' 比例按分して
Propria persona (pro per) ='In one's own person' 代理人によらず 本人が
Quasi ='As if , Almost' 準〜 に準じる
Spura ='Above' 以上 超えた 上記に 上に
Status quo ='The condition in which' 現状の
Urtra vires ='Beyond the power' 権限踰越 能力外
Vice versa ='Reversely' 逆もまた同様に 逆に
Viz. (Videlicet) ='It is permitted to see' すなわち

ロンドンはすっかり秋が深まりました。日本のようにしっかりした葉っぱのまま色づく木は少ないように思います。この写真のように木に付いている時点で枯葉状態になっているものがほとんど…。とはいえ、芝生とのコントラストが綺麗なのがイギリスならではかな、と思います。
